ILANGA NATURE SA has established this privacy policy with the aim of providing transparent information to users of the website hosted at the following address : https://www.ilanga-nature.com/ , (ci-après le « Site » ), the way in which personal data is collected and processed by ILANGA NATURE SA.

The term "User" refers to any user, whether a natural or legal person, who visits or interacts in any way with the website.

In this respect, ILANGA NATURE SA determines all the technical, legal and organisational means and purposes of processing Users's personal data. To this end, ILANGA NATURE SA undertakes to take all necessary measures to ensure that personal data is processed in accordance with the Law of 30 July 2018 on the protection of individuals with regard to the processing of personal data (hereinafter, "the Law" ) and the European Regulation of 26 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter, the "Regulation" ).

ILANGA NATURE SA is free to choose any natural or legal person who processes the personal data of users at its request and on its behalf (hereinafter the "Processor"). Where applicable, ILANGA NATURE SA undertakes to select a Subcontractor offering sufficient guarantees as to the technical and organisational security measures for the processing of personal data, in accordance with the Law and the Regulation.

1. Processing of personal data

The use of the Site by the Users may lead to the communication of personal data. The processing of such data by ILANGA NATURE, as the Data Controller, or by service providers acting in the name and on behalf of ILANGA NATURE SA, will comply with the Law and the Regulation.
Personal data will be processed by ILANGA NATURE SA, in accordance with the purposes mentioned below, via:
An automated procedure; 
The newsletter registration form; 
The use of cookies; 
The sending of surveys or questionnaires.

2. Purpose of the processing of personal data

In accordance with Article 13 of the Regulation, the purposes of processing personal data are communicated to the User and are as follows :
    1. To ensure the execution of the services offered and agreed upon on the Site;
​2. To monitor the performance of the services offered;
​3. To carry out marketing activities and promotional information after prior consent from the User and until such consent is revoked, for example the sending of promotions on the products of the Data Controller;
​4. To answer the User's questions;
​5. To carry out statistics in order to improve the Website, the services offered and the internal organisation of its operation;
​6. To improve the quality of the Website and the products and/or services offered by the Data Controller;
​7. To enable better identification of the User's interests.

3. General Information

When visiting and using the Website, the User agrees that the following personal data is collected and processed in accordance with the terms and principles described in this Privacy Policy :
    1. The information of the Users that they give for contractual purposes and to allow the proper execution of the reciprocal obligations, namely the surname, first name, address, IBAN number and banking data, etc ; and more generally, any information voluntarily given by the User; 
    2. The Users' information by filling in forms or by contacting the Users' e-mail address and telephone number by telephone. 
    3. For each user visit on the Website, the information automatically collected is;

    b. l’ensemble de l’information concernant les pages que l’Utilisateur a consultées sur le Site, notamment L’URL, le temps de navigation…

4. Consent

By accessing and using the Site, the User declares that he has read and marked his agreement in a free, specific, enlightened and unambiguous way to the processing of personal data concerning it. This agreement covers the content of this Privacy Policy.
The consent is given by the positive act by which the User has checked the box offering the Privacy Policy hyperlinked.
This consent is an indispensable condition for performing certain operations on the Site or for allowing the User to enter into a contractual relationship with ILANGA NATURE SA. Any contract between ILANGA NATURE SA and a User concerning the services and goods offered on the Site is subject to the acceptance of the Privacy Policy by the User.
The User consents to the Controller’s processing and collection, in accordance with the terms and principles included in this Privacy Policy, its personal data that it communicates on the Site or on the occasion of the services offered by ILANGA NATURE SA, for the purposes indicated above.
The User has the right to withdraw his consent at any time. Withdrawal of consent does not compromise the lawfulness of processing based on prior consent.

5. Period of retention of Users' personal data

In accordance with Article 13 §2 of the Regulation and the Law, the Controller retains personal data only for the time reasonably necessary to enable the fulfilment of the purposes for which it is processed.

This duration will in all cases be less than 3 years.

6. Recipients of data and disclosure to third parties

Personal data may be transmitted to employees, employees, subcontractors who offer guarantees of security of adequate data, and who collaborate with ILANGA NATURE SA in the context of the provision of services. They act under the direct authority of ILANGA NATURE SA, and are notably responsible for collecting, processing or subcontracting this data.
In all cases, the recipients of the data and those to whom they have been disclosed respect the content of this Privacy Policy. ILANGA NATURE SA ensures that they will process this data for the intended purposes only, in a discreet and secure manner.
In the event that the data is disclosed to third parties for direct marketing or prospecting purposes, the User will be informed beforehand so that he expresses his consent to the use of this personal data.

8. Users' rights

At any time, the User may exercise his rights by sending an email to the following address: infos@ilanga-nature.com, or a letter by post addressed, enclosing a copy of his identity card at the following address: Nicolas Darche Street, 14, 5660, Couvin.

1. Right of access

In accordance with Article 15 of the Regulation, ILANGA NATURE SA guarantees the User’s right of access to his personal data. The User has the right to obtain access to said personal data as well as the following information :

  • the purposes of the processing;
  • the categories of personal data concerned;
  • the recipients or categories of recipients to whom the personal data have been or will be communicated, in particular recipients established in third countries or international organisations;
  • where possible, the period of retention of personal data envisaged or, where this is not possible, the criteria used to determine that period;
  • the existence of automated decision-making, including profiling, referred to in paragraphs 1 and 4 of Article 22 of the Regulation, and, at least in such cases, useful information concerning the sub-logicthe importance and expected consequences of this treatment for the data subject

The Controller may charge a reasonable fee based on administrative costs for any additional copies requested by the User.

When the User makes such a request electronically (through the electronic address, for example), the information is provided in a commonly used electronic form, unless the User requests otherwise.

The copy of its data will be communicated to the User at the latest within one month after receipt of the request.

2. Right to rectification

ILANGA NATURE SA guarantees the right of rectification and erasure of personal data to the user.

In accordance with Article 16 of the Regulation, incorrect, inaccurate or irrelevant data may be corrected or deleted at any time. The User first makes the necessary changes himself from his user/other account, unless these cannot be done autonomously, in which case the request can be made to ILANGA NATURE SA.

In accordance with Article 19 of the Regulation, the Controller shall notify each recipient to whom the personal data have been communicated any rectification of the personal data, unless such communication is impossible or requires disproportionate effort. The controller shall provide the data subject with information on these recipients if requested by the data subject.

3. Right to erasure

The User has the right to obtain the erasure of his personal data as soon as possible in the hypotheses listed in article 17 of the Regulation.

When the Data Controller has made the personal data public and is required to delete them under the previous paragraph, the Data Controller, taking into account the available technologies and the costs of implementation, take reasonable measures, including technical measures, to inform the other controllers processing this personal data that the data subject has requested that these controllers delete any link to this personal data, or any copy or reproduction thereof.

The two preceding paragraphs do not apply to the extent that this treatment is necessary:

  • the exercise of the right to freedom of expression and information;
  • ​to comply with a legal obligation that requires treatment under Union law or the law of the Member State to which the controller is subject, or to carry out a mission of public interest or falling within the exercise of public authority by the controller;
  • at the establishment, exercise or defence of legal rights.

In accordance with Article 19 of the Regulation, the Controller notifies each recipient to whom the personal data have been communicated any erasure of personal data or any limitation of the processing carried out, unless such communication is impossible or requires disproportionate effort. The controller shall provide the data subject with information on these recipients if requested by the data subject.

4. Right of limitation of treatment

The User has the right to obtain the limitation of the processing of his personal data in the hypotheses listed in article 19 of the Regulation.é

In accordance with Article 19 of the Regulation, the Controller notifies each recipient to whom the personal data have been communicated any limitation of the processing carried out, unless such communication is impossible or requires disproportionate effort. The controller shall provide the data subject with information on these recipients if requested by the data subject.

5. Right to data portability

In accordance with Article 20 of the Regulation, Users have the right to receive their personal data from ILANGA NATURE SA in a structured, commonly used and machine readable format. Users have the right to transmit this data to another controller without ILANGA NATURE SA hindering it in the cases provided for in the Regulation.

When the User exercises his right to data portability under the preceding paragraph, he has the right to have the personal data transmitted directly from one controller to another, where this is technically possible.

The exercise of the data portability right is without prejudice to the right to erasure. This right does not apply to the processing necessary for the performance of a mission of public interest or falling within the exercise of the public authority of which the controller is invested.

The right to data portability does not affect the rights and freedoms of third parties.

6. Right of objection and automated individual decision-making

The User has the right at any time to object to the processing of his personal data due to his particular situation, including the automation of data performed by ILANGA NATURE SA. In accordance with Article 21 of the Regulation, ILANGA NATURE SA will no longer process personal data, unless there are legitimate and compelling reasons for the processing that prevail over the interests and rights and freedoms of the User, or for the establishment, the exercise or defence of legal rights.

When personal data are processed for prospecting purposes, the User has the right to object at any time to the processing of personal data concerning it for such prospecting purposes, including profiling to the extent that it is related to such prospecting.

Where the data subject objects to processing for prospecting purposes, personal data shall no longer be processed for that purpose.

7. Right to complain

The User has the right to lodge a complaint concerning the processing of his personal data by ILANGA NATURE SA with the Data Protection Authority, competent for the Belgian territory. Further information can be found on the website: https://www.autoriteprotectiondonnees.be

10. Limitation of liability of the Data Controller

The website may contain links to other websites owned by third parties not related to ILANGA NATURE SA. The content of these sites and their compliance with the Act and the Regulations are not the responsibility of ILANGA NATURE SA.

The holder of parental authority must give express consent for the minor under 16 years of age to disclose personal information or data on the website. ILANGA NATURE SA urges the people exercising parental authority over minors to promote responsible and safe use of the Internet. The Data Controller cannot be held responsible for having collected and processed personal information and data of minors under 16 years of age whose consent is not actually covered by that of their legal parents or for incorrect data -In particular with regard to age- introduced by minors. Under no circumstances will personal data be processed by the Controller if the User specifies that he is under 16 years of age.

ILANGA NATURE SA is not responsible for the loss, corruption or theft of personal data caused in particular by the presence of viruses or following computer attacks. 

11. Security

The Data Controller implements organisational and technical measures to ensure an appropriate level of security for data proce"ssing and collection. These security measures depend on the costs of implementation in terms of the nature, context and purposes of the processing of personal data.

The Controller uses standard encryption technologies within the IT sector when transferring or collecting data on the Site.

12. Modification of the Privacy Policy

ILANGA NATURE SA reserves the right to modify this Privacy Policy in order to comply with the relevant legal obligations. The user is therefore invited to consult the Privacy Policy on a regular basis in order to be aware of the modifications and adaptations. Such a modification will be posted on the Site or sent by email for the purpose of opposability.

13. Applicable law and jurisdiction

This Privacy Policy is exclusively governed by Belgian law. Any dispute will be brought before the courts of the judicial district of the registered office of ILANGA NATURE SA, namely the Courts of Namur.
